If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Avai-lability is a resource management platform that provides:
- Team capacity planning and allocation management
- Project and client tracking
- Skills management and matching
- AI-powered resource optimization
- Forecasting and analytics
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice.
3. User Accounts
Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.
Account Security
You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.
Organization Accounts
Organization administrators are responsible for managing user access and permissions within their organization. They must ensure all users comply with these Terms.

We will make reasonable efforts to provide advance notice of scheduled downtime.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Panairiam Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

- Your violation of any third-party rights

11. Termination
Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in the Service.

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice.
Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your data in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination will survive.

These Terms shall be governed by and construed in accordance with the laws of NSW, Australia, without regard to its conflict of law provisions.
Dispute Resolution Process
Any disputes arising from these Terms or your use of the Service shall first be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through Australian Courts in Sydney.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
